Are the Police Allowed to Search Your Computer or Cell Phone Without a Warrant?

Can police search your cell phone or computer? Since your computer and cell phone hold so much personal information and sensitive data, they are most worthy of protecting from prying eyes, including those of the government. In addition, if the police have a warrant or if you consent to a search, the police can search your computer or phone. But unless the police have probable cause to believe that there is evidence of a crime on your computer or cell phone, they cannot obtain a warrant to search it in the first place. The 4th Amendment to the U.S. Constitution protects individuals from unreasonable searches and seizures. That protection extends to people and property and applies wherever someone has a reasonable expectation of privacy. Consent – if you consent to a search, then, the police do not need a warrant.

Stop and Frisk.

Administrative Searches.

Incident to Lawful Arrest.

Even if you are arrested, the police still need a warrant to search your computer or phone.

Police can search your devices at the border without a warrant.

If the police do obtain a warrant, remember:

  • You do not have to assist law enforcement or answer any of their questions when they are conducting their search.
  • Law enforcement has the right to take your computer and search it.
  • In some jurisdictions, you do not have to hand over encryption keys or passwords.
  • You may be able to get your computer back if it is taken and searched.
  • You may have less constitutional protection if a search of your computer or cell phone occurs at your job.
