What should you know and expect about bonding and bailing if you or a loved one is arrested? Some criminal defendants are bailed out and some are bonded out.
When a person is arrested, they go before a judge who will decide the terms of their bail order. Bail is money is cash money pledged to the court to secure release from jail with the promise that the understanding the defendant will return for all court appearances and trials. If a defendant does not return to court or trial, their bail is forfeited and they may face charges for failing to appear. If they do make all court appearances, their bail may be returned regardless of the outcome of the trial.
If a defendant is considered a threat to society, bail may be denied and may not be allowed to be released from jail. In this case, a third party can pledge a bond. A bond order can be granted by a judge in a case where release is permitted. There are four types of bonds under the categories of secured and unsecured bonds. One rare type is for a defendant to be released on his or her own recognizance. The other three are cash paid to the court, property bonds offering the defendant’s title to their property to the court and surety bonds which are when a third party agrees to be responsible for the obligation. Bond money will be paid for services will not be returned.
